MINUTES

TOWN OF OCEAN RIDGE

SPECIAL MASTER CODE ENFORCEMENT HEARING

AUGUST 10, 1999

Present: Ken Spillias, Interim Town Attorney; Karen Hancsak, Town Clerk; and Edward Hillery, Director of Public Safety.

Meeting called to order at 8:55 A.M.

A. Special Master Randy Zeldin approved the minutes of June 16, 1999.

  1. VIOLATION HEARING

CASE #CE99-18 GREEN MACHINE MANAGEMENT CORP.

RE: 25 Hudson Ave.

Attorney Spillias summarized the Affidavit and Notice of Violation by stating that the respondent was in violation of Section 14-136(c), Ocean Ridge Code of Ordinances and Chapter 162, Florida Statutes by not spreading fill on the lot by August 9, 1999. He commented that the violation citing Section 34-6(a) has been brought into compliance.

The respondent was present and Mr. Liddy and Director Hillery were sworn in.

Prior to the meeting a stipulation was reached by both parties. Atty Spillias requested a recess at 9:00 AM in order to discuss the impending fine should the violation not be brought into compliance and at 9:05AM the meeting was reconvened. Special Master Randy Zeldin was advised that both parties agreed that the violation would be brought into compliance by Aug. 24, 1999 failing which a $50.00 daily fine would be imposed.

Special Master Randy Zeldin clarified that Mr. Liddy and Green Machine Management Corp. were both respondents and that by him accepting the stipulation he was responsible for both parties. Mr. Liddy stated that he understood. Mr. Zeldin advised that he would prepare the Final Order based on the agreed upon stipulation.

RE: 39 Spanish River Drive

Atty Spillias advised that this violation was brought into compliance prior to the meeting.

The meeting was adjourned at approximately 9:00 AM.
