Special Meeting of the Town Commission of the Town of Ocean Ridge held on Monday, May 3, 1999 in the Town Hall Meeting Chambers at 6:00 PM.

The meeting was called to order by Mayor Aaskov and roll call was answered by the following:

  1. Request to Appeal Lot Violation Liens By: Anton Ritlop, property owner of Lot 51, McCormick Mile (River Drive)

Town Manager Dunham explained that Anton Ritlop had requested to appeal lot-mowing violations to the Town Commission and would be represented at the meeting by Anita Silverman. He explained that Mr. Ritlop had been sent several letters regarding lot violations and, as a result, has several liens on the property. He stated that Mr. Ritlop appealed his last $300 fine before the Special Master and it was dismissed. He added that the liens were placed because Mr. Ritlop did not respond to the previous letters or request an appeal before the Special Master at that time.

Anita Silverman stated that Mr. Ritlop had not received the previous letters because they were sent to an address in Georgia and he had been living in Canada. She stated that the letter from February 18, 1998 was the first notice of any violation he had received in the thirteen years that he owned the lot. She stated that Mr. Ritlop had hired Walcott and Son to take care of the property.

Regarding the appeal which was heard by the Special Master, Mrs. Silverman advised that the picture of the lot taken by the Department of Public Safety shows only the vegetation being higher than one foot and not the grass. She explained that the vegetation was placed there purposely to discourage people from going through the lot to the seawall. Atty Nicoletti explained that the cases which are being appealed at this meeting all occurred long ago and have nothing to do with the picture from March which was shown to the Special Master. He added that at that appeal hearing, the Special Master found that the vegetation was not a violation and added that at that time, Mr. Ritlop admitted that not all of the grass has been cut at all times. Comm Kaleel reiterated that the violations which were being appealed were older cases. Mrs. Silverman advised that all the notices had been sent to an old address in Georgia to which Atty Nicoletti advised that the town only needed to send them to the address in the current taxroll which is the Georgia address. Town Clerk Hancsak advised that certified letters had been signed for at the Georgia address.

Comm Kaleel moved not to reduce any of the liens for lot violations at Lot 51, McCormick Mile stating that the Town Clerk and the town staff did their duty by sending the notices and recording the liens when the letters were not responded to and that the Town Commission needed to back-up its code by not reducing the fines, seconded by Comm Bridges.

Motion carried – yea 5.

Mrs. Silverman stated that she felt this was a great injustice as the letters were not sent to the correct address and Mr. Walcott, an honorable man, has been cutting the lot as he should.
