MINUTES

TOWN OF OCEAN RIDGE

SPECIAL MASTER CODE ENFORCEMENT HEARING

DECEMBER 11, 2001

Present: Ken Spillias, Town Attorney, Gregory Dunham, Town Manager, Karen Hancsak, Town Clerk, Director Edward Hillery, and Lt. Stefan Katz.

Meeting called to order at 10:00 A.M.

  1. The minutes of September 11, 2001 were adopted at this hearing.

Special Master Torcivia explained that this was an informal hearing and rules of evidence were not required, however, the Town may have exhibits that a respondent has the right to make objections to. She added that the Town would present their case and then the respondent may ask questions and be given the opportunity to present their side after which she would render a decision and issue a Final Order.

At this point all individuals that were prepared to give testimony were sworn in.

  1. VIOLATIONS

CASE NO. CE2001-08 Edward Dickman, 10 Grace Avenue, Great Neck, NY 11021

RE: 32 Anna Street, Ocean Ridge or legally described as Lot 11, Coastal Shores West

NATURE OF VIOLATION

Violate Section 14-154(a), 14-15(b), and 14-156 of the Town Code of Ordinances by not removing all construction debris from the site and not installing a 5’ chain link fence around the pool as indicated on the demolition permit.

Robert Jacobs, representative for the respondents, was present.

Special Master Torcivia accepted the following evidence as Town exhibits: the executed return receipt for the Certified Letter as #1, and 12 photographs (8 taken Nov. 15, 2001 by Director Hillery and 4 taken on Dec. 11, 2001) by Lt. Katz as #2.

Special Master Torcivia questioned whether there was an agreed upon stipulation that she could incorporate into a Final Order regarding this violation. Atty Spillias advised that the town and Mr. Jacobs have agreed that the property owner will come into compliance with the erection of a fence around the pool and the removal of the debris within one week from this date. He added that the respondent would be responsible for $185.00 in administrative costs which will also be delivered within one week failing which would result in a $250.00 daily fine.

Special Master Torcivia inquired the affiliation between Mr. Jacobs and the property owner to which he advised that he was the builder. She clarified that both parties agreed with the stipulation. She advised that she would prepare a final order stating that the respondent must erect a fence around the pool as shown on the approved permit, remove the debris and remit a $185.00 payment for administrative costs by December 18, 2001.

The meeting was adjourned at approximately 10:15 AM.
