MINUTES

TOWN OF OCEAN RIDGE

SPECIAL MASTER CODE ENFORCEMENT HEARING

JANUARY 22, 2002

 Present:  Glen Thomas, Attorney representing Town, Gregory Dunham, Town Manager, Karen Hancsak, Town Clerk, Director Edward Hillery, and Sgt. William Hallahan.

 Meeting called to order at 10:00 A.M.

 A.                 The minutes of December 11, 2001 were adopted at this hearing.  

 Special Master Torcivia explained that this was an informal hearing and rules of evidence were not required, however, the Town may have exhibits that a respondent has the right to make objections to.  She added that the Town would present their case and she would render a decision and issue a Final Order since the respondent was not present.

At this point all individuals that were prepared to give testimony were sworn in. 

B.                 VIOLATIONS

CASE NO. CE2001-09           Carlton Forbes, 1520 N.W. 107th Drive , Coral Springs , FL 33071

RE:       32 Spanish River Dr , Ocean Ridge or legally described as Lot 32, 33 & 44 Inlet Cay Subdivision

                                                            NATURE OF VIOLATION

Violate Section 34-6 of the Town Code of Ordinances by permitting the lot to become overgrown.

Special Master Torcivia accepted the following evidence as Town exhibits: the Affidavit and Notice of Violation, Section 34-6, 3 receipts for certified mail and the executed return receipt for the Certified Letter as #1; 6 photographs taken this date still showing noncompliance by Sgt. Hallahan as #2; the owner information as provided by the Palm Beach County Property Appraiser as #3; a handwritten worksheet outlining the administrative costs of $388.29 as #4; and the previous overgrown complaint reports as #5.

Special Master Torcivia questioned whether anyone had spoken to the respondent.  Director Hillery advised that he and Lt. Katz had observed the violation on Dec. 27, 2001 and added that Lt. Katz had spoken to Mr. Forbes on the day that the notice was sent ( 12/28/01 ), however, Lt. Katz is currently in Arizona .  Special Master Torcivia then asked when the original violation was observed to which she was given complaint reports that showed various violations since March 22, 2001 , however, the original date of this violation was Nov. 28, 2001 .  The Special Master then advised that any future violations of the same nature could be considered repeat violations and subject to a $500.00 daily fine.

Glen Thomas recommended compliance within a few days or a $250.00 daily fine and reimbursement of administrative fees.

 Special Master Torcivia stated that she would make a finding of violation stating that if compliance is not met by Jan. 25, 2002 a $250.00 daily fine would accrue, and also administrative fees in the amount of $388.29 are due by Jan. 31, 2002 failing which would continue the $250.00 fine.  

C.        Adjournment

The meeting was adjourned at approximately 10:30 AM.
