Special Town Commission Meeting of the Town of Ocean Ridge held on Wednesday, October 30, 2002 at 3:00 PM in the Town Hall meeting chambers.

 The meeting was called to order by Mayor Kaleel and roll call was answered by the following:

Action Items

A.        Continue review of 1st draft of code revisions (majority encompassing building and land development code)

Following is a list of the proposed code revisions and discussed and approved by the Town Commission.

Pg 70 – draft provision to require a driveway and requirements for single family, including prohibition against rock, shell, and pebble driveways and to ensure consistency of driveway requirements through the land development code

Pg 78 – prohibit exterior residential equipment, e.g. air conditioning units, to be placed in the setback limit or separate setbacks for equipment or require to be placed in the rear setback

Pg 78 – require a permit for satellite dish antennae that are sized larger than could fit in a one meter cube

Pg 79 – eliminate listing of height exceptions and create a special exception mechanism

Pg 80 – look at Freedom of religion Act to ensure that zoning regulations can be used to regulate size of churches

Pg 84 – draft requirements for mooring floats for wave runners with no permit requirements

Pg 86 – add docks to requirements for seawalls and bulkheads maintenance

Pg 114 – draft provision on cost of review of engineering plans for completion certificate and who pays in the event of a dispute; make clear demarcation of decision by town official and procedures for review

Pg 118 – request advice for federal telecommunications issues requirements on local governments

Pg 126 – expound definition of temporary structures to require permit for PODS and the like to prevent them from parking on the lot

Pg 127 – change onsite stormwater retention to hold a minimum of one inch of runoff

Pg 128 – research whether DEP or DERM require light restrictions from 3/1 through 10/31 and prohibits special exceptions for special events: if special exceptions allowed, provide for Town Manager or administrative official approval

Pg 140 – provide for Town to conduct its won building inspections in the future – determine if any changes needed to Code

Pg 150 – eliminate the word “xeriscape” and use “water-efficient landscape” wherever applicable

Pg 152 – prohibit planting of a ficus as hedge along easements and rights-of-way and determine when a hedge becomes a tree

Pg 157 – define removal of dune plants and time limit to replace plants when Town requires their removal; add ficus as a prohibited plant on the dune

Pg 162 – draft requirement for placement of sanitary facilities at construction sites

Pg 164 – research whether Board of Adjustment needs to grant variances for finished floor elevations east of the CCCL if proposed elevation has been approved by DEP

Pg 166 – research whether there is a need for a definition of finished floor elevation or use zero datum

Pg 167 – for drainage, add requirement of non-disturbance of adjoining properties and prohibit planting in swales

Pg 169 – provide for administrative official to grant one six-month extension for construction start and then Town Commission to grant any further extensions on its discretion

Pg 101 and 171 – create a different cost/review requirement for subdivisions as opposed to single-family construction

Pg 191 – research whether Town may regulate size of political signs
