Ordinance No. 543
AN ORDINANCE OF THE TOWN OF OCEAN RIDGE, FLORIDA, ADOPTING AN ANNUAL
BUDGET FOR THE YEAR BEGINNING OCTOBER 1, 2003 AND ENDING SEPTEMBER 30, 2004;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 166.241(3), Florida Statutes (1997) requires a
municipality to make appropriations for each fiscal year that do not exceed the
amount to be received from taxation and other revenue sources; and
WHEREAS, it was discovered that said statute was amended to require
municipalities to adopt their budget “by ordinance, unless otherwise specified
in the municipality’s charter;” and
WHEREAS, the Town has adopted its budget by Resolution for several years,
which conformed to Florida Statutes; and
WHEREAS, there is not enough time to otherwise comply with the
requirements for the adoption of an ordinance with two readings, and adopt an
annual budget by October 1, 2003; and
WHEREAS, Section 166.041, Florida Statutes (1997), permits the adoption
of emergency ordinances, except as otherwise provided by law; and
WHEREAS, all of the TRIM compliance measures have been achieved,
including the two required public hearings, and all advertising requirements.
NOW THEREFORE, BE IT HEREBY ORDAINED BY THE TOWN COMMISSION OF THE TOWN
OF Section 1.
Emergency Declared.
Because there is not enough time to undertake and complete the normal
ordinance adoption procedures, and still adopt an annual budget by Section 2. Budget
Adopted.
The appropriations for the fiscal year beginning

Operating Expenses:
$3,322,655.00
b. General
Obligation Bond Debt Service:
$ 152,270.00
Section 3.
Repeal of Conflicting Ordinances.
All Ordinances, Resolutions or parts of Ordinances and Resolutions in
conflict herewith are hereby repealed.
Section
4.
Severability.
If any word, clause, sentence, paragraph, section or part thereof
contained in this Ordinance is declared to be unconstitutional, unenforceable,
void or inoperative by a court of competent jurisdiction, such declaration shall
not affect the validity of the remainder of this ordinance.
Section 5.
Effective
Date. This ordinance shall
become effective immediately upon adoption.
