 ORDINANCE NO. 544  

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA , AMENDING THE RECREATION AND OPEN SPACE AND CAPITAL IMPROVEMENT ELEMENTS OF THE TOWN OF OCEAN RIDGE COMPREHENSIVE PLAN TO REFLECT RECENT CAPITAL IMPROVEMENT PROJECTS, AND PROVIDING FOR AN EFFECTIVE DATE.  

WHEREAS, the Planning and Zoning Commission, sitting as the Local Planning Agency, after notice and public hearing, has considered the appropriateness of proposed amendments to the Recreation and Open Space and Capital Improvements Elements of the Comprehensive Plan of the Town of Ocean Ridge and has submitted its recommendation to the Town Commission; and

WHEREAS, the Town Commission, after notice and public hearing, voted to transmit the proposed amendment to the State land planning agency for written comment and has otherwise complied with applicable provisions of the Florida Statutes governing amendments of Comprehensive Plans; and  

WHEREAS, the notice and hearing requirements for Comprehensive Plan amendments, as set forth in the Florida Statutes, have been satisfied; and  

WHEREAS, the Town Commission has taken the recommendations of the Local Planning Agency and the comments from the public into consideration.  

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMISSION OF THE TOWN OF OCEAN RIDGE:

Section 1.  The portions of the Goals, Policies and Objectives of the Recreation and Open Space and Capital Improvements Elements of the Comprehensive Plan that are hereby amended shall read as follows:

I.          Goals, Objectives & Policies           

Policy 1.2.3:  The drainage Level of Service Standard shall will be to adequately detain runoff from one inch of rain in one hour.  If economically and practically achievable, the Town shall deliver a greater Level of Service Standard consistent with the Goals, Objectives and policies of the Comprehensive Plan.  

            Policy 1.1.7:  The Town shall research and attempt to secure grants to implement capital improvements projects consistent with the Goals, Objectives and Policies of the plan.

·        There are minor significant drainage deficiencies, particularly in the southern portion of the Town, and; six small scale improvement projects are needed to correct ponding.; estimated cost of less than $5,000 each, based upon Town Manager consultation with contractor.

Financial Resources

Federal Grant Funding:  Previously, the Town received The only recent direct Federal grants has been  in the form of General Revenue Sharing and but this has now been phased out.  The Town does receive grant funding to implement specific projects.

ANALYSIS

Fiscal Implications of Deficiencies and Cost Estimates

Based upon the Land Use Plan goals, any future project planning will give first priority to those projects that enhance the residential neighborhoods.  This primarily takes the form of infrastructure upgrading.  The principal fiscal implication is that given the size and tax base of Ocean Ridge, bonding and grants will be required to supplement the General Fund operating budget.  This is particularly true of such potential long-term needs as storm sewer outfall elimination and sanitary sewer extension into the Town.

Ocean Ridge currently receives no Federal funds and has no impact fees.

Implications of This Fiscal Analysis

3.  Therefore, if a tax increase is to be avoided, the Town will have to borrow, or bond, or receive grants for any significant capital projects as is planned for the water distribution system improvements.
