AN ORDINANCE OF THE
TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA, AUTHORIZING THE REVISION OF
THE FUTURE LAND USE MAP (FLUM) TO AMEND THE DESIGNATION OF 1.35 ACRES, MORE OR
LESS, LOCATED ON THE WESTERN BOUNDARY OF SPANISH CREEK AT THE PROPERTY KNOWN AS
SPANISH BAY, WEST OF NORTH OCEAN BOULEVARD, AS DESCRIBED MORE PARTICULARLY
HEREIN, FROM SINGLE FAMILY RESIDENCE TO MEDIUM DENSITY MULTI-FAMILY RESIDENCE
AND PROVIDING AN EFFECTIVE DATE. WHEREAS,
the Town Commission, as the governing body of the Town of Ocean Ridge,
Florida pursuant to authority in Chapter 163 and Chapter 166, Florida Statutes,
and the Town of Ocean Ridge Land Development Code, as adopted by the Town of
Ocean Ridge, is authorized and empowered to consider petitions related to zoning
and land development orders; and WHEREAS, the
Planning and Zoning Board, sitting as the Local Planning Agency, after notice
and public hearing, has considered the appropriateness of the proposed small
scale amendment to the Future Land Use Map of the Comprehensive Plan of the Town
of Ocean Ridge and has submitted its recommendations to the Town Commission; and WHEREAS, the Town
Commission, after notice and public hearing, voted to adopt the proposed small
scale amendment and forward the amendment package to the State land planning
agency and has otherwise complied with applicable provisions of the Florida
Statutes governing small scale amendments of Comprehensive Plans; and WHEREAS, the notice
and hearing requirements for small scale Comprehensive Plan amendments, as set
forth in the Florida Statutes, have been satisfied; and WHEREAS, the Town
Commission has taken the recommendations of the Local Planning Agency and the
comments from the public into consideration. NOW, THEREFORE, BE
IT ORDAINED BY THE TOWN COMISSION OF THE TOWN OF OCEAN RIDGE: Section 1.
The Future Land Use Map of the Comprehensive Plan is hereby amended and
shall indicate that the 1.35 acre parcel which is the property located to the
west of the western boundary of Spanish Creek at Spanish Bay which is comprised
of the property at 6460 through 6490 North Ocean Boulevard and an adjacent
un-numbered parcel west of North Ocean Boulevard has been changed from Single
Family Residence to Medium Density Multi-family Residence.
The parcel being more particularly described as: LEGAL DESCRIPTION: TOGETHER WITH THE FOLLOWING DESCRIBED PARCELS: PARCEL 1: THE NORTH 100’ OF THE SOUTH 520.17 FEET, (LESS THE
WEST 60 FEET THEREOF) OF THAT PORTION OF GOVERNMENT LOT 5, IN SECTION 22,
TOWNSHIP 45 SOUTH, RANGE 43 EAST, LYING WEST OF SPANISH CREEK, IN OCEAN RIDGE,
PALM BEACH COUNTY, FLORIDA. PARCEL 2: THE NORTH 33.24 FEET OF THE SOUTH 420.17 FEET OF THAT
PORTION OF GOVERNMENT LOT 5, IN SECTION 22, TOWNSHIP 45 SOUTH, RANGE 43 EAST,
LYING WEST OF SPANISH CREEK, IN OCEAN RIDGE, PALM BEACH COUNTY, FLORIDA. PARCEL 3: THE NORTH 109.13 FEET OF THE SOUTH 387.46 FEET THAT
PORTION OF GOVERNMENT LOT 5, IN SECTION 22, TOWNSHIP 45 SOUTH, RANGE 43 EAST,
LYING WESTERLY AND ADJACENT TO OCEAN BOULEVARD RIGHT OF WAY IN OCEAN RIDGE, PALM
BEACH COUNTY, FLORIDA. ALSO KNOWN AS: THE NORTH ½ OF THE NORTH 5 ACRES OF THE SOUTH 8 ACRES
OF GOVERNMENT LOT 5, IN SECTION 22, TOWNSHIP 45 SOUTH, RANGE 43 EAST, PALM BEACH
COUNTY, FLORIDA, LYING WEST OF OCEAN BOULEVARD, OCEAN RIDGE, FLORIDA. PARCEL 4: THE WEST 60 FEET OF THE NORTH 100 FEET OF THE SOUTH
520.17 FEET OF THAT PORTION OF GOVERNMENT LOT 5, IN SECTION 22, TOWNSHIP 45
SOUTH, RANGE 43 EAST, LYING WEST OF SPANISH CREEK, IN OCEAN RIDGE, PALM BEACH
COUNTY, FLORIDA. ADDRESS: Section 2.
The Town Manager is hereby authorized and directed to make appropriate
changes to the Future Land Use Map of the Town to effectuate the purpose of this
ordinance. Section 3. Effective Date. The effective date of this plan amendment shall be: The date a final order is issued by the Department of Community Affairs finding the amendment to be in compliance in accordance with Chapter 163.3184, F.S.; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Section 163.3184, F.S. |
