ORDINANCE NO. 547 AN ORDINANCE OF
THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA, AMENDING SECTION
64-2(d)(3) OF THE CODE OF ORDINANCES TO INCREASE THE MAXIMUM BUILDING HEIGHT OF
MULTI-FAMILY BUILDINGS IN THE RMM RESIDENTIAL DISTRICT; PROVIDING FOR
CODIFICATION; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section
64-2(d)(3), Code of Ordinances, provides for a maximum building height of 32
feet for multiple family residential buildings in the RMM residential district;
and WHEREAS, single
family dwellings in the RSF, RSE and RHM residential districts are permitted a
maximum building height of 36 feet; and WHEREAS, multiple
family buildings in the RHM residential district are permitted to have a maximum
building height of 44 feet; and WHEREAS,
the Town Commission has determined that for purposes of consistency and
for good and aesthetic architectural reasons, a maximum building height of 36
feet for multi-family buildings in the RMM district is in the best interests of
the citizens and residents of the Town.
NOW, THEREFORE, BE
IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF Section 1.
Amendment. Section 64-2(d)(3) is hereby amended to read as
follows:
Maximum building height. Maximum
building height is
64-1 as applicable to single family dwellings
section
64-41(b)(2) as applicable to accessory uses,
buildings
or structures. Section 2.
Codification. This
ordinance shall be codified in the Code of Ordinances of the Town of Ocean
Ridge, Florida. Section 3.
Severability. If any word, clause, sentence, paragraph, section or
part thereof contained in this Ordinance is declared to be unconstitutional,
unenforceable, void or inoperative by a court of competent jurisdiction, such
declaration shall not affect the validity of the remainder of the Ordinance. Section 4.
Repeal. All Ordinances or parts of Ordinances in conflict
herewith shall be and the same are hereby repealed. Section 5.
Effective Date. This Ordinance shall become effective immediately upon adoption. FIRST READING
this 6th day of July, 2004. |
