ORDINANCE NO. 564

 

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA, CORRECTING THE CHAPTER AND SECTION NUMBER REFERENCES OF ORDINANCE NO. 562, AMENDING THE CODE OF ORDINANCES AT CHAPTER 30, ARTICLE V, OF THE CODE OF THE TOWN OF OCEAN RIDGE AS IT PERTAINS TO CABLE TELEVISION FRANCHISES; CORRECTING THE CHAPTER REFERENCE TO CHAPTER 15 OF THE CODE OF THE TOWN OF OCEAN RIDGE AS IT PERTAINS TO CABLE TELEVISION FRANCHISES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, on December 5, 2005, by emergency ordinance, the Town Commission enacted an ordinance entitled “An Ordinance Repealing and Replacing Chapter 30, Article V, of the Code of the Town of Ocean Ridge as it Pertains to Cable Television Franchises; Providing Penalties for Violation of the Provisions Hereof; Providing Inclusion in the Code; Repealing all Ordinances or Parts of Ordinances in Conflict Herewith; and Providing an Effective Date” as Ordinance No. 562; and

 

WHEREAS, due to a scrivener’s error, the Ordinance improperly referred to Chapter 30, Article V, of the Town’s Code of Ordinances as the section being repealed and replaced; and

 

WHEREAS, as a result of the scrivener’s error, the chapter and section numbers set forth throughout the Ordinance as approved are also in error; and

 

WHEREAS, the correct chapter that the Ordinance applies to is Chapter 15 of the Code of the Town of Ocean Ridge; and

 

WHEREAS, attached hereto is a corrective Ordinance No. 562, with the proper chapter and section numbers set forth; and

 

WHEREAS, the intention of the Town Commission was to enact Ordinance No. 562 as attached hereto but for the scrivener’s error.

 

NOW THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA, AS FOLLOWS:

 

Section 1.      Correction and Replacement.   Ordinance No. 564, as set forth in the attachment, corrects the scrivener’s error occurring in Ordinance No. 562, as originally enacted by the Town Commission on December 5, 2005, and hereby replaces, in all of its terms and provisions, the said erroneously numbered Ordinance. 

 

Section 2.      Codification. The attached corrected Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Ocean Ridge, Florida.

 

Section 3.      Severability.  If any word, clause, sentence, paragraph, section or part thereof contained in this Ordinance is declared to be unconstitutional, unenforceable, void or inoperative by a court of competent jurisdiction, such declaration shall not affect the validity of the remainder of the Ordinance.

 

Section 4.      Repeal.  All Ordinances or parts of Ordinances in conflict herewith shall be repealed.

 

Section 5.      Effective Date.  This Ordinance shall become effective immediately upon adoption.

 

          FIRST READING this 9th day of January, 2006.

 

          SECOND AND FINAL READING this 6th day of February, 2006.

 

          Commissioner Pugh offered the foregoing Ordinance and its adoption. The motion was seconded by Commissioner Bingham and upon being put to a vote, the vote was as follows:
