ORDINANCE NO. 574
AN ORDINANCE OF THE TOWN OF OCEAN RIDGE, FLORIDA CHANGING THE NAME OF DOLPHIN DRIVE TO DOLPHIN ROAD ON THE RECORDED PLAT; DIRECTING THE CLERK OF THE CIRCUIT COURT OF PALM BEACH COUNTY TO MAKE THE NECESSARY NOTATIONS OF THE CHANGE ON THE RECORDED PLAT; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the plat recorded at Plat Book 23, Page 119, of the Public Records of Palm Beach County, Florida, identifies one of the streets contained thereon as Dolphin Drive; and
WHEREAS, in County and U.S. Postal Service records the street has long been identified as and known as Dolphin Road; and
WHEREAS, the difference in name between the street as platted and the street as commonly referred to, including by its residents, has caused confusion and uncertainty; and
WHEREAS, the Town Commission has determined that it is in the interest of the public to remove the uncertainty and have references made to the street by its common usage coincide with the official plat.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE, FLORIDA, AS FOLLOWS: Section 1. Findings of Fact. The WHEREAS clauses set forth above are adopted herein as findings of fact.
Section 2. Change of Name. The Town Commission hereby officially and formally changes the name of the street known as Dolphin Drive, as found in Plat Book 23, Page 119, of the Public Records of Palm Beach County, Florida, to Dolphin Road
Section 3. Directions to the Clerk of the Circuit Court. The Clerk of the Circuit Court of Palm Beach County, Florida, is authorized and directed to place in the margin of the plat a notation that this Ordinance has been passed changing the name, the date of the name change and the book and page in the public records where the Ordinance is recorded.
Section 4. Repeal of Ordinances. Any ordinance in conflict herewith, to the extent of such conflict is hereby repealed.
Section 5. Severability. In the event any Section, Paragraph, Sub-paragraph, Sentence, Clause, Phrase or Word of this Ordinance shall be declared invalid, illegal or unenforceable by a court of competent jurisdiction, such declaration shall not affect the validity of the remaining portions hereof.
Section 6. Effective Date. This Ordinance shall take effect immediately after adoption or as provided by law.
